Announcement on Strengthening Safety Administration on Dangerous Substances Including Explosives, Hyper-toxic Chemicals, and Radioactive Isotopes Implemented in Shanghai
The Announcement of Shanghai Municipal People’s Government on Strengthening Safety Administration on Dangerous Substances Including Explosives, Hyper-toxic Chemicals, and Radioactive Isotopes was adopted at the 71st Routine Meeting of the Municipal People’s Government on March 15, 2010, signed by Mayor Han Zheng, promulgated by Decree No. 29 of the Municipal People’s Government on March 26, and be implemented from April 15 to November 15, 2010. The whole text of the Announcement has been made public on the following websites: www.shanghai.gov.cn, www.shanghailaw.gov.cn, and www.eastday.com, and will be published on Jiefang Daily.
With a view to ensuring the public security during the holding of Shanghai Expo in this Municipality, the Announcement sets out different administrative and control measures for four kinds of dangerous substances including explosives for civilian use, specified dangerous chemicals, hyper-toxic chemicals, and radioactive isotopes, and mainly includes the following contents:
I. As for explosives for civilian use, the Announcement makes clear that public security organs may suspend the examination and approval on explosive operation permits, or inform the party that have such permit to stop the explosive operation; when transporting explosives for civilian use in this Municipality, the party concerned shall choose the vehicles and drivers approved by the related public security organ ,and follow the time and route approved; when transporting explosives for civilian use with a relatively high danger, the party concerned shall entrust the municipal security escort company to escort the transportation; the warehouse for explosives for civilian use shall store up the explosives according to the storage capacity approved, and the storage unit shall report regularly the situation about the storage and the in and out registration every month; and the units importing and exporting explosives for civilian use shall report their importation and exportation to the department concerned for the record.
II. As for specified dangerous chemicals, the Announcement prohibits the selling of the same to individuals (except for a small amount of potassium permanganate), and specifies the rules governing the suspension of examination and approval, the real-name purchase, and the registration and filing for buying and selling such dangerous chemicals.
III. As for hyper-toxic chemicals, the Announcement sets the limitation on the production amount, and suspends the exanimation and approval of new permits for hyper-toxic chemicals operation; where an individual purchases a raticide, or pesticide containing hyper-toxic chemicals, the real-name purchase, and the registration and filing for buying and selling such hyper-toxic chemicals shall be practiced; when transporting hyper-toxic chemicals into this Municipality or transporting hyper-toxic chemicals in this Municipality by out-of-town vehicles, the party concerned shall entrust the security escort company to escort the transportation; and the warehouse in this Municipality shall suspend the storage of out-of-town hyper-toxic chemicals on a commission basis.
IV. As for radioactive isotopes, the Announcement suspends in principle the use of radiation installations containing radioactive source such as gamma-ray flaw detectors, and the dislocated use of radioactive isotopes, suspends the delivery of discarded radioactive source (wastes) to depots, and suspends the flaw detecting operation of out-of-town enterprises by using gamma-ray in this Municipality; the production and sales of radioactive isotopes and the production of radioactive drugs shall be reported for record; where a unit uses radioactive isotopes frequently or in a large amount, it shall take inventory every month; the vehicles transporting type I, II, III radioactive source shall be escorted.
