Three Announcements on City Appearance and Traffic Issues Including One Enhancing the Investigation and Handling of Illegal Passenger Transportation with Motor Vehicles Officially Implemented in Shanghai

The Announcement of Shanghai Municipal People's Government on the Enhancement of Investigation and Handling of Illegal Passenger Transportation with Motor Vehicles, the Announcement of Shanghai Municipal People's Government on Strengthening This Municipality’s Liability Division Administration of the City Appearance and Environmental Sanitation, the Announcement of Shanghai Municipal People's Government on Strengthening This Municipality's Administration of Safe Transportation of Building Wastes and Construction Refuse Soil were adopted at the 73^rd Routine Meeting of the Municipal People's Government on April 3, 2010. Signed by Mayor Han Zheng and promulgated by Decree No. 32, Decree No. 41 and Decree No. 42 of the Municipal People's Government respectively, these Announcements shall be effective as of the date of their promulgation. 1. In order to increase the rectification force on illegal passenger transportation acts with motor vehicles, the Announcement of Shanghai Municipal People's Government on Enhancement of the Investigation and Handling of Illegal Passenger Transportation with Motor Vehicles makes clear that, from the period of April 15, 2010 to December 31, 2010, the acts of non-commercial passenger transportation motor vehicles running on roads as taxicabs, and the acts of the drivers of non-commercial passenger transportation motor vehicles or other people soliciting passengers in public places, shall be punished by the traffic administrative law enforcement agency once being found out. In addition, in respect of the acts of taking on passengers by charging ordinary fees but with no conclusive evidence to prove its illegal operation intention, punishment shall be imposed upon if such acts are found for the fourth time by the traffic law enforcement agency. The Announcement also stresses that the law enforcement agency shall not adopt any abnormal evidence-gathering means such intimidation, temptation or cheating in the course of the law enforcement.

2. In order to push ahead with the implementation of this Municipality's liability division system of city appearance and environmental sanitation and create a favorable environment for the smooth hosting of the World Expo 2010 Shanghai, the Announcement of Shanghai Municipal People's Government on Strengthening This Municipality's Liability Division Administration of City Appearance and Environmental Sanitation makes clear that from the period of April 15, 2010 to October 31, 2010, any liability person of city appearance and environmental sanitation who runs business out of doors, windows or external walls or pile articles in the public places such as on public roads without authorization may be ordered to stop production or close down business for less than seven days by the industry and commerce administration department if such person commits such act again after being punished for three times for the same act.

    3. In dealing with the problem of the frequent traffic accidents triggered by this Municipality's vehicles transporting building wastes, the Announcement of Shanghai Municipal People's Government on Strengthening This Municipality’s Administration of Safe Transportation  of Building Wastes and Construction Refuse Soil makes clear that from the period of April 15, 2010 to December 31, 2010, those transportation units with less than 20 transportation vehicles shall not undertake the transportation of construction refuse soil. Transportation vehicles shall meet the corresponding technical standards of vehicles, and be installed with turning signs and sound cueing devices; the transportation vehicle that does not meet the requirements shall not transport construction refuse soil. Drivers shall possess more than three years' experience for driving oversize vehicles, and may take up the job only after he or she is qualified through the specific safe transportation training. A driver who has born the full responsibility or main responsibility for two times for road traffic accidents and caused fatality shall be prohibited to take up the job. According to the Announcement, a transportation unit shall be punished by revoking its transportation permit for construction refuse soil if a driver or drivers of such unit has or have born full responsibility or main responsibility for a accident or accidents and caused three persons or more dead, or the driver or drivers were punished for three times or more because of disposing or transporting construction refuse soil without authorization, failing to use airtight equipment, or overloading transportation within 30 days.
